He had to be warned and he never was proper notified, Harrasment rule says he must be warned.
No warning given to him but suddently ban.. good..
But the rules say:

First offense: Warning
Second offense: Three day ban
Third offense: Seven day ban
Fourth offense: Permanent ban

Yes a "warning" was given by mail. It also stated the next time he did it, it is a bannable offense.

Edit: Decided to double check. He got the mail. He even talked about it in chat logs.
