I'd say the whole PvP mode is likely the best option. While your idea is intriguing, GMNyx, it feels like more work than its worth and too many ways to exploit it, and it sounds more complicated than it needs to be.
How about this;
In own-nation maps, against same-nation people, unless you are in PK mode, you cannot be PKd and (obviously) cannot PK anyone.
So, if you are in Battle, someone in PK mode cannot attack you. And you cannot attack someone in PK mode. If someone is in PK mode, they can attack others in PK mode, and get attacked in turn.
If possible to enable that, it would be a quick and easy solution. At least, I think so.
Then we can leave neutral maps alone (since some people actually like leveling in neutral maps for the chance of encountering lower levels to PK with.) Otherwise, the whole below level 100 system also messes it up if it doesn't take into account different nations.
